Terms of service

Welcome to Flossing. These Terms of Service ("Terms") set out the conditions under which we sell our products and under which you use our website. Please read them carefully: they describe your rights, our obligations and what you can expect from us.

Nothing in these Terms limits your statutory rights as a consumer under Dutch or Belgian law. Where any provision conflicts with mandatory consumer law, that law prevails.

In these Terms, "we", "us" and "our" refer to Flossing. "You" refers to the person visiting our website or placing an order.


2. Scope, language and record of your order

These Terms apply to every visit to our website and to every order placed through it. We sell and deliver to the Netherlands and Belgium only.

You can conclude your purchase in Dutch or English. The language you use when placing your order is the language of your contract with us. If a translated version of these Terms differs in meaning, the version in the language of your order applies.

We store every order electronically in our Shopify environment. After ordering you receive an order confirmation by email containing the details of your purchase; we recommend keeping it. You can request a copy of your order details from us at any time.

We may amend these Terms. The version that applies to your order is the version published at the moment you place it.


3. Using our website

You may use our website for lawful purposes only. To place an order you must be at least 18 years old and legally able to enter into a contract.

We do not offer customer accounts. All orders are placed as a guest, so there are no login credentials to protect. You do need to provide accurate contact, billing and delivery details; if they are incomplete or incorrect we may be unable to deliver your order.

We may restrict or refuse access to our website if it is used in breach of section 14.


4. Our products

Flossing sells water flossers and replacement tips for daily oral care. Our products carry the CE marking and comply with the applicable European product requirements.

We do our best to show our products accurately. Colours and appearance may still differ from what you see on screen, depending on your device and its settings. Minor differences of this kind do not make a product non-conforming.

Product descriptions and our range may change at any time. We may discontinue a product or limit the quantity available per customer.

Our products support daily oral care; they are not medical devices and do not replace treatment by a dentist or dental hygienist. If you have pain, persistent bleeding gums, or you are undergoing dental treatment, consult a qualified professional before use. Always follow the manual and safety instructions supplied with your product.


5. Orders and the contract

When you place an order you make an offer to purchase. The contract comes into effect once we have confirmed your order by email. We will process your payment as part of that confirmation.

We may decline an order, for example if a product is unavailable, if your details appear incorrect, if payment fails, or if we reasonably suspect misuse or fraud. If we decline or cancel your order we will tell you promptly and refund any amount already paid.

We do not offer pre-orders or backorders. Products shown as available are in stock.


6. Prices and payment

All prices shown are in euros and include VAT. Any shipping costs are calculated and shown in your basket before you complete your order, so you always see the full amount before paying.

The price that applies is the price displayed at the time you place your order, as confirmed in your order confirmation. Prices may change at any time, but a change never affects an order already confirmed.

We accept the following payment methods:

Payment is made in full at the time of ordering. We do not offer payment terms or invoicing, other than as agreed individually for larger business orders under section 9.


7. Shipping and delivery

We deliver to addresses in the Netherlands and Belgium.

These are the delivery times we work towards, not guarantees. Delays can occur through the carrier or through circumstances outside our control.

We will always deliver within 30 days of your order at the latest. If we cannot, you may set us a reasonable additional period; if we still fail to deliver, you may cancel the order and we will refund you in full without delay.

Risk of loss or damage. If you order as a consumer, the risk passes to you once you, or someone you have designated, have taken physical possession of the product. Until then, any loss or damage in transit is ours. If you order as a business, the risk passes when we hand the products to the carrier.

Please check your order on arrival and let us know promptly if anything is damaged, missing or incorrect. Our Refund Policy explains what happens next.


8. Cancellation, returns and warranty (consumers)

As a consumer you have a statutory right of withdrawal of 14 days from the day you receive your order. You may cancel for any reason, without giving a justification. On top of this, we voluntarily offer a total return window of 30 days.

Every Flossing product carries a 2-year commercial warranty against manufacturing and technical defects under normal use. This warranty is additional to, and never limits, your statutory rights. Under consumer law a product must do what you can reasonably expect of it, for as long as you can reasonably expect such a product to last — a period that can exceed two years.

The full conditions, the exclusions (opened tip boxes), the return address, who pays return shipping and the model cancellation form are set out in our Refund Policy, which forms part of these Terms.


9. Business customers

This section applies if you order in the course of a business or profession. Where it conflicts with any other section, this section prevails for business orders.

  • No right of withdrawal. The statutory 14-day withdrawal right applies to consumers only. Our voluntary 30-day return window is likewise offered to consumers; for business orders, returns are at our discretion.
  • Larger orders. Bulk or wholesale orders fall outside our standard checkout. Terms of payment, delivery and pricing for such orders are agreed individually and in writing in advance.
  • Resale. Our products are supplied for your own use unless we have expressly agreed otherwise in writing. You may not resell, export or distribute them commercially without our written consent.
  • Inspection. You must inspect delivered products on arrival and report any visible defect or shortfall in writing within 7 days; other defects within 14 days of discovery.
  • Liability. Our liability towards business customers is limited to the invoice value of the order concerned. We are not liable for indirect or consequential loss, including lost profit, lost revenue, lost savings, business interruption or reputational damage. The limits in section 16 that protect consumers do not restrict this limitation.

10. The Flossing Club

The Flossing Club is our free email community for better oral care, with helpful tips, education and exclusive offers. It is designed to help you build a simple routine for healthier gums and a fresher smile.

Membership is free. There is no subscription, no recurring payment and no minimum term. You join by subscribing with your email address and you can leave at any time using the unsubscribe link in any email. Content shared through the Flossing Club is general guidance and does not replace professional dental advice.

We may change or discontinue the Flossing Club at any time.


11. Reviews and anything you send us

Reviews shown on our website are collected through independent platforms, currently Trustpilot and bol.com, and are displayed under those platforms' own terms. We do not write, edit or filter them, and we do not offer payment or incentives in exchange for a positive review. Reviews reflect the experience of individual customers, not a promise about your own result.

Content you send us — questions, suggestions, ideas, photos or other material shared with us by email or social media — remains yours. By sending it, you give us permission to use it for improving our products, services and communication, and to share it in our own channels where you have agreed to that. We will always ask before using your name or a recognisable photo of you in marketing.

You are responsible for what you send us. Please do not send material that infringes someone else's rights, or that is unlawful, misleading or offensive. We are under no obligation to keep the material confidential, to respond to it, or to pay for it.


12. Intellectual property

All content on our website, including text, photography, images, graphics, logos, branding and product materials, belongs to Benjamin George Goldsmith, trading as Flossing, or to our licensors, and is protected by intellectual property law.

"Flossing" is a trademark registered with the Benelux Office for Intellectual Property (BOIP).

You may use our website for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, republish, store or transmit our content without our prior written permission. All rights not expressly granted are reserved.

Shopify's name, logo and product names are trademarks of Shopify. Other names and logos on our website belong to their respective owners.


13. Third-party links and tools

Our website may link to, or embed functionality from, websites operated by third parties. We do not control those websites and are not responsible for their content, accuracy or practices. If you follow a link and leave our website, their terms and privacy policies apply. Any third-party tools made available through our website are provided as they are, without warranty from us.


14. Prohibited use

You may not use our website:

  • for any unlawful, fraudulent or malicious purpose;
  • to infringe our intellectual property rights or those of others;
  • to harass, abuse, defame or harm any person;
  • to transmit false or misleading information, spam or unsolicited advertising;
  • to impersonate another person or misrepresent the origin of a message;
  • to upload viruses or any other malicious code;
  • to collect or track other people's personal data;
  • to copy, extract, resell or otherwise exploit any part of our website;
  • to use robots, spiders, scrapers, data-extraction tools or automated means to access our website;
  • to interfere with, bypass or circumvent our security measures.

We may suspend or block access to our website if you breach this section.


15. Automated agents

This section applies if you use, enable or deploy an automated agent to access or interact with our website. An "agent" is any software or service that acts autonomously or semi-autonomously on behalf of a person or organisation, without direct supervision.

Agents may only access our website if they identify themselves as such. Specifically, an agent must:

  1. identify itself in every HTTP/HTTPS request by including Agent/[agent name] in the user agent string;
  2. not conceal that it is an agent, including by imitating human behaviour or by solving or circumventing CAPTCHAs and similar measures;
  3. answer truthfully when asked whether an interaction comes from a person or a machine;
  4. not circumvent any measure intended to block, limit or control how agents access our website.

We may restrict or block agent access by technical means, and we may ask a particular agent to stop accessing our website altogether.


16. Liability

We are liable for damage caused by our failure to meet our obligations, in accordance with the law. Nothing in these Terms excludes or limits our liability for:

  • death or personal injury;
  • intent or deliberate recklessness on our part;
  • defective products under product liability law;
  • any other liability that cannot be excluded or limited by law.

Beyond that, and to the extent permitted by law, our liability towards consumers is limited to foreseeable loss arising directly from our failure. We are not liable for delays or failures caused by circumstances outside our reasonable control, including carrier disruption, extreme weather, strikes, power or network failure, or government measures (force majeure). If a force majeure situation lasts longer than 30 days, either of us may cancel the order and we will refund any amount you have paid.

Information on our website about oral care is general in nature. We take care to keep it accurate, but you use it at your own discretion and it does not replace advice from a dentist or dental hygienist.

For business customers, the limitation in section 9 applies.


17. Errors and inaccuracies

Our website may occasionally contain a typographical error or inaccuracy, for example in a product description, price, shipping charge or availability. We may correct such errors and update the information at any time.

If an obvious error means a product was offered at a clearly incorrect price, we may cancel the order even after confirming it, provided we tell you promptly. You will then receive a full refund, and of course you are free to reorder at the correct price.


18. Privacy

We handle your personal data in accordance with our Privacy Policy, which explains what we collect, why, how long we keep it and what rights you have.

Because our store is hosted by Shopify, Shopify also processes data about your visit and purchase, in some cases for its own purposes. Our Privacy Policy explains this in more detail.


19. Relationship with Shopify

Flossing is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Flossing. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Flossing, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Flossing.


20. Complaints and disputes

If something is wrong, tell us first — most issues are resolved quickly and informally. Email info.flossing@gmail.com or call +31 6 83 65 79 69. We reply to every complaint within 24 hours, and where a complaint needs further investigation we tell you what to expect and keep you informed until it is resolved.

If we cannot resolve it together, you may bring the matter before the competent court. As a consumer you can always bring proceedings in the country where you live, and you retain the protection of the mandatory rules of that country's law.


21. General

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in force. The invalid provision will be replaced by one that comes as close as possible to its intended meaning and effect.

No waiver. If we do not enforce a right or provision, that does not mean we give it up.

Entire agreement. These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, form the whole agreement between us regarding your use of our website and your purchase.

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example if the business is sold, provided this does not reduce your rights.

Survival. Sections on intellectual property, liability, complaints and governing law continue to apply after the contract ends.


22. Governing law

These Terms and any contract concluded through our website are governed by Dutch law.

If you are a consumer resident in Belgium or another EU member state, you retain the protection afforded to you by the mandatory provisions of the law of your country of residence, and you may always bring proceedings before the courts of that country.

Disputes will otherwise be submitted to the competent court in the Netherlands.
